เมื่อวันที่ ๒๖ ตุลาคม ๒๕๖๕ นางสาวจิตวิภา เบญจศีล ผู้อำนวยการกองการสังคม กรมองค์การระหว่างประเทศ ร่วมเป็นผู้บรรยายในงานเปิดตัวรายงานเรื่อง “การกักตัวผู้เข้าเมืองผิดกฎหมายและทางเลือกแทนการกักตัวในภูมิภาคเอเชียแปซิฟิก” (Immigration Detention and Alternative to Detention in the Asia-Pacific Region) ซึ่งจัดโดย สำนักงานข้าหลวงใหญ่สิทธิมนุษยชนแห่งสหประชาชาติ (Office of the United Nations High Commissioner for Human Rights: OHCHR) ณ โรงแรม Athenee Hotel กรุงเทพฯ

รายงานดังกล่าวจัดทำขึ้นโดย International Detention Coalition (IDC) ผ่านการสนับสนุนของเครือข่ายสหประชาชาติว่าด้วยการโยกย้ายถิ่นฐาน และ Sweden.se เพื่อติดตามความคืบหน้าในการดำเนินการตามข้อตกลงระหว่างประเทศเพื่อการโยกย้ายถิ่นฐานที่ปลอดภัย เป็นระเบียบ และปกติ (Global Compact for Safe, Orderly and Regular Migration) โดยเฉพาะวัตถุประสงค์ข้อ 13 ซึ่งระบุว่า มาตรการกักตัวควรเป็นทางเลือกสุดท้ายที่รัฐใช้ต่อผู้เข้าเมืองผิดกฎหมายและเรียกร้องให้รัฐแสวงหาและใช้ทางเลือกอื่นทดแทนมาตรการดังกล่าว โดยได้มีการศึกษาแนวทางการดำเนินการต่อผู้เข้าเมืองผิดกฎหมาย โดยเฉพาะการใช้มาตรการกักตัวและมาตรการทางเลือกแทนการกักตัว ในประเทศต่างๆ ในภูมิภาคเอเชียแปซิฟิกจำนวน 19 ประเทศ รวมถึงประเทศไทย ซึ่งได้รับการยอมรับว่ามีความก้าวหน้าด้านการใช้มาตรการทางเลือกแทนการกักตัวเด็กผู้โยกย้ายถิ่นฐานที่เข้าเมืองผิดกฎหมาย โดยมีเจตนารมณ์ทางการเมืองระดับผู้นำที่นำไปสู่การกำหนดนโยบายและแนวปฏิบัติที่ชัดเจน อีกทั้ง มีการทำงานร่วมกับองค์กรภาคประชาสังคมในการให้การดูแลเด็กที่ได้รับอนุญาตให้อาศัยในชุมชนแทนการถูกกักตัว นอกจากนี้รายงานยังกล่าวถึงบทบาทนำของไทยฐานะ GCM Champion Country ในการผลักดันให้มีการใช้มาตรการทางเลือกแทนการกักเด็กผู้โยกย้ายถิ่นฐาน ผ่านการแบ่งปันความรู้ ประสบการณ์และแนวปฏิบัติที่ดีผ่านเวทีต่างๆ ทั้งในระดับภูมิภาคและระดับโลก

ในโอกาสดังกล่าว นางสาวจิตวิภาฯ ได้นำเสนอข้อมูลเกี่ยวกับประสบการณ์ของไทยในการใช้มาตรการทางเลือกแทนการกักเด็กผู้โยกย้ายถิ่นฐานรวมถึงการจัดทำ“บันทึกความเข้าใจการกำหนดมาตรการและแนวทางแทนการกักตัวเด็กไว้ในสถานกักตัวคนต่างด้าวเพื่อรอการส่งกลับ” ซึ่งมีพื้นฐานจากหลักการสำคัญ คือ การคำนึงถึงประโยชน์สูงสุดของเด็ก การให้การคุ้มครองสิทธิเด็ก โดยคำนึงถึงพันธกรณีตามอนุสัญญาสิทธิเด็กและพิธีสารเลือกรับทั้งสามฉบับซึ่งไทยเป็นภาคี นอกจากนี้ ผู้แทนจาก IOM, HOST International และ Asylum Seeker Support Trust  ยังได้ร่วมให้ข้อมูลและแบ่งปันประสบการณ์ในงานดังกล่าวด้วย.

Director of Social Division, Department of International Organizations participated in the Launch Event of the report on “Immigration Detention and Alternative to Detention in the Asia-Pacific Region”.

On October 26, 2022, Ms. Jitvipa Benjasil, Director of the Social Division, Department of International Organizations, participated in the public launch event of the International Detention Coalition (IDC)’s report on “Immigration Detention and Alternative to Detention in the Asia-Pacific Region” hosted by Office of the United Nations High Commissioner for Human Rights (OHCHR) at Athenee Hotel, Bangkok. 

The report tracked progress of the implementation of the Global Compact for Safe, Orderly and Regular Migration (GCM), particularly of its’ objective 13, which encouraged States to “use immigration detention only as a measure of last resort and work towards alternatives” and mapped out the use of immigration detention and alternatives to immigration detention (ATD) in 19 countries in the Asia-Pacific Region. Thailand has been recognized for its progressive efforts in the implementation of ATD through the establishment of policy to end detention of migrant children and provide them with alternatives to detention, as well as close collaboration with civil society organizations in the provision of community-based care. The report also mentioned Thailand’s role, as a GCM Champion Country that “has emerged as a regional and global leader in its efforts to end child immigration detention and develop community-based ATD for children and their families” through active engagement and sharing of experience, knowledge and good practice in various regional and global peer learning initiatives.

On this occasion, Ms. Jitvipa also shared Thailand’s experience and perspective on the implementation of ATD, in accordance with the “MOU on the Determination of Measures and Approaches Alternatives to Detention of Children in Immigration Detention Centers (ATD-MOU)”, which is based on the principle of the best interest of the child and the protection of children’s rights as enshrined in the Convention on the Rights of the Child and its 3 Optional Protocols, to which Thailand is a State Party. Representatives from the International Organization for Migration (IOM), HOST International and Asylum Seeker Support Trust also made presentations to share information and experiences on ATD from perspective of international organization and civil society working on the issue.
